Early Life Filippo (Giordano) Bruno was born in Nola, Italy in 1548; his father was Giovanni Bruno, a soldier, and his mother was Fraulissa Savolino. In 1561, he enrolled in school at the Monastery of Saint Domenico, best known for its famous member, Thomas Aquinas. Around this time, he took the name Giordano Bruno and within a few years had become a priest of the Dominican Order. Life in the Dominican Order Giordano Bruno was a brilliant, albeit eccentric, philosopher whose ideas rarely coincided with those of the Catholic Church. Nevertheless, he entered the Dominicanà convent of San Domenico Maggiore in Naples in 1565 where he assumed the name Giordano. His outspoken and heretical beliefs were noted by his superiors, but he was nevertheless ordained as a priest in 1572 and sent back to Naples to continue his studies. While in Naples, Bruno discussed his heretical views aloud, including the Arian heresy which stated that Christ was not divine. These actions led to steps being taken toward a trial for heresy. He fled to Rome in 1576 and fled again in 1576 after some of his forbidden writings were uncovered. Leaving the Dominican order in 1576, Bruno wandered Europe as a traveling philosopher, lecturing in various universities. His chief claim to fame were the Dominican memory techniques he taught, bringing him to the attention of King Henry III of France and Elizabeth I of England. Brunos memory enhancement techniques, including mnemonics, are described in his book, The Art of Memory and are still used today. Crossing Swords With the Church In 1583, Bruno moved to London and then to Oxford, where he presented lectures discussing the Copernican theory of a sun-centered universe. His ideas were met with a hostile audience, and, as a result, he returned to London where he became familiar with the major figures of the court of Elizabeth I. While in London, he also wrote a number of satirical works as well as his 1584 book, Dell Infinito, universo e mondià (Of Infinity, the Universe, and the World). The book attacked the Aristotelian vision of the universe, and, building on the works of the Muslim philosopher Averroà «s, suggested that religion is a means to instruct and govern ignorant people, philosophy as theà disciplineà of the elect who are able to behave themselves and govern others. He defended Copernicus and his sun-centered vision of the universe, and further argued that the universe was infinite, that it contained an infinite number of worlds, and that these are all inhabited by intelligent beings. Bruno continued his travels, writing and lecturing in England and Germany through 1591. During this time, Bruno both intrigued and angered local scholars. He was excommunicated in Helmstedt and asked to leave Frankfurt am Main, finally settling at a Carmelite monastery where he was described by the prior as ââ¬Å"chiefly occupied in writing and in the vain and chimerical imagining of novelties.â⬠Final Years Inà Augustà 1591, Bruno was invited to return to Italy and, in 1592, was denounced to the Inquisition by a disgruntled student. Bruno was arrested and immediately turned over to the Inquisition to be charged with heresy. Bruno spent the next eight years in chains in Castel Santââ¬â¢Angelo, not far from the Vatican. He was routinely tortured and interrogated. This continued until his trial. Despite his predicament, Bruno remained true to what he believed to be true, stating to his Catholic Church judge, Jesuit Cardinal Robert Bellarmine, I neither ought to recantà nor will I. With this strategy Tesco establishment a strong customer base. They also kept and grew their customer base by introducing new services within the organisation and by way of their advertising both in store and online. They introduced a clubcard that encouraged and continues to encourage customers to shop online with rewards. To keep their customer base strong they use different advertising and marketing methods such as sending customers mails using effective mediums which include both direct mail and electronic mail. Advertising is can be done in store and is even more effective using the online medium such as advertising on Google or sites that are used regularly by general web browsers. Services such as insurance, visa cards, saving accounts, music downloads and gas filling stations where some of the services introduced by Tesco. The products and services offered by Tesco meets or at times exceed the expectations of customers. The brand name Tesco uses allows customers to identify them and the products and services they provide even though other companies provide similar products and services. Tescos strategy of branching out into different locations was a major move which allowed them to target all groups of customer wants and needs with the products and services they offered. They also branch out into international markets and expand their products and services into different cultures. Tescos move to the online arena allowed them to target all groups all at once and allow their customers to purchase items that are in or out of season and are not available in store. They also grant them five dollar discounts to encourage them to shop on the online market. Tescos have an advantage over their competitors and due to this fact the prices they offer for the same products are much lower allowing more customers to come into Te sco instead of the competitors. Dependence on the UK market is considered a weakness because of their dependence on UK suppliers for their products. Tesco can turn their dependence on the UK market into strength by outsourcing products with equal or superior quality than the products they currently offer. Tesco dominates the market but in certain cities, Tescos competitors have monopolised the cities. In order for this monopoly by their competitors to be destroyed Tesco needs to open more branches within the cities and boost up their services to gain a wide range of customers in those cities. 3.2. Personal data shall be processed in accordance with the rights of data subjects under this Act. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data. Personal data shall not be transferred to a country or territory outside the European Economic Area unless that country or territory ensures an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data. [opsi 2008] According to the principles of the Data Protection Act 1998 above Tesco must ensure that: When Tesco.com collects information from a data subject, the data subject must be aware that their information is being captured and because they agree to it. This information is obtained when a customer registers an account with Tesco.com. This information will be used by Tesco.com to create a profile for the individual. Tesco.com must let the data subject know why they are collecting this information and how it will be used both now and in the future. They need to let the data subject know if they data will be sent to third parties or not and how long they will keep this information stored. The data requested by Tesco.com must be relevant according to their needs. It must also be information that a customer will feel comfortable disclosing. Tesco.com must ensure that the data being collected and processed from a data subject is accurate and up-to-date. When a customer requests the closure of their account Tesco.com should delete all data concerning that customer or they will be in violation of the fifth principle in the Data Protection Act 1998. Tesco.com should supply information to the data subject without hesitation once they request it. In gathering information Tesco.com must ensure that the data stored is safe and secure. In distributing data Tesco.com must ensure that the data subject agrees to it or the country to which the information is being transferred to must have proper data protection or else there will be a breach of the Data Protection Act 1998 principle 8. According to the Privacy and Electronic Communications Regulations Act, Tesco.com must see to it that the e-mail sent to customers where based on the customers opt-in or consent to receive e-mails and should also have the option for them to opt-out or un-subscribe to getting e-mails. Family Law Contemporary Issues
Family law has been broadened in a wide range of areas that the law governs, as over the years the concept of family has been widely diversified due to changes in modern society and community standards. Family law governs areas such as marriage, family relationships, legal rights and obligations of parents and children, adoption and the protection and care of children within a family. However, over the recent years the changes in each area of family law has shown some changes have been effective and others demonstrate the need for law reform. This is due to the rapid change of the law and changing social standards, therefore the law is attempting to balance the rights and interest of the society and individual family members. The legal recognition of same sex relationships in Australia has dramatically evolved over the years. Same sex relationships have tackled huge issues in regards to marriage, discrimination and property rights. As same sex relationships have been excluded from a number of rights and obligations for example; the legal recognition of same sex marriage. The Marriage Act 1965 (Cth) defines marriage as ââ¬Ëthe legal union of a man and women with the exclusion of othersââ¬â¢. Therefore same sex marriage is void in Australia even those who have married in another country it will be seen as an invalid marriage. Having the lack of legal recognition can have direct consequences to same sex relationships and their families as they are excluded from the protections and rights that normal heterosexual couples and families have. This is demonstrated in the Young V Australia (1999) case, where a Sydney man was refused for a veteranââ¬â¢s dependent pension as he was in a same sex relationship. In this incident the United Nations Human Rights Committee (UNHRC) determined the Australian government had breached the International Covenant of Civil and Political Rights (ICCPR), as ââ¬Ëall persons are equal before the law. ââ¬â¢ Not only has it breached the ICCPR but it has breach the Sex Discrimination Act 1984. Therefore, this demonstrates how the legal system is ineffective as there is a lack of enforceability with regards to the role that the international law plays in Australia. In order to create equality in the legal system for same-sex relationships the Australian Human Rights Commission report in 2008 had introduced reforms with the aim to provide same sex couples with the same entitlements as heterosexuals. The most significant reform was the introduction of the Property (Relationships) Legislation Amendment Act 1999 (NSW). This has allowed de facto elationships to have the right to divide property as seen in the Hope and Brown v NIB Health Fund Ltd (1995). In this case the Equal Opportunity Tribunal had played an effective role as it has shown to be successfully in achieving justice and equality for same sex relationships. It has also protected the 2 year old son in which Hope and Brown were now permitted to give their child a family policy for his future. Therefore, the reforms th at have occurred in the past decade have been successful as it has given some rights and obligations towards same sex relationships. In NSW 241 300, reports were made about concerns of childââ¬â¢s or young personââ¬â¢s safety according to the Special Commission of Inquiry into child protection services NSW. The concern of the protection and care of both children and individual members under both the Family Law Act 1975 (Cwth) and the Crimes Act 1900 (NSW) is the increasing rate of family neglect, abuse and domestic violence. This issue is rapidly increasing each year as the crime rate of children has increased to 70% of young children committing crime due to being neglected or abused in reference to Australian Bureau Statistics (ABS). The government has made numerous amendments and reforms to the Crimes Act 1900 (NSW) e. g. Crimes (Domestic Violence) Amendment Act 1987 (NSW), due to increased domestic violence cases within the domestic household. Over the years there have been a number of cases where family members have suffered domestic violence which has resulted in some of them murdering their husbands or partners, e. g. R v Heather Osland 1996 (VIC). Therefore, the legal system has shown how further amendments and reforms can protect individual family members effectively. But the government needs to step up and focus on providing more resources and funds to smaller organisations e. g. Docs. The government has created the Department of Community Services (DOCs) under the Children Young Persons (Care and Protection) Act 1998. This organization helps protect children who are suffering abuse or neglect. Majority of the time Docs have overseen incidentsââ¬â¢ and have failed to report any sort of child abuse, neglect or domestic violence. As shown recently in 2012 August 03 in the Sydney Morning Herald (SHM) ââ¬ËAbuse Children were ignored by a welfare workerââ¬â¢. The Department of Community Services have failed to protect and prevent children from harm due to being under resourced and not having the adequate resources to protect children. The Australian government should provide efficient resources e. g. having more people involved with better wages in protecting minors. This would therefore be more effective in protecting children and their rights. Without this new reform in the legal system it will increase the number of children who are in great harm, as recently seen in the media ââ¬ËEbony reportââ¬â¢- ââ¬Å"reveals history of Docs neglectâ⬠. For individual members to feel safe and protected the law has added extra provisions on the Crimes (Domestic Violence) Amendment Act 1982 which amended the Crimes Act 1900 (NSW), has included victims who suffer from domestic violence have the right to seek AVOââ¬â¢s. Many people do not fulfill their responsibility towards their children and sometimes having a divorce within the family can cause major conflicts and struggles on the couple, and most importantly the child. As the NSW Bureau of Crime Statistics and Research (BOSCAR) shows that inadequate parenting is associated with child neglect, to some extent these are the strongest predictors of juvenile crime as 36% of young people are cautioned. One of the most serious of these cases are children having the thought of committing suicide. As seen in one of the most recent cases Merrett and BASS 2013. This demonstrates how the strenuous tension between a couple can have on child. As a parent they have the responsibility to ensure that their child receives an education and to discipline their child. In the re Marion (1991) it demonstrates how the child had no right or say in her medical procedures. Therefore, the United Nations Convention on the Rights of Children (CROC) has not been effective as it has not been ratified, which therefore it hasnââ¬â¢t protected the childââ¬â¢s best interest. One of the most recent reforms to the Children and Young Persons (Care and Protection) Act 1988 (NSW) is that if a child has broken the law e. g. underage drinking or damages on property, the parents are penalized for their childââ¬â¢s actions. Another reform that has shown to ineffective is the introduction of the Family Law Amendment (Shared Parental Responsibility) Act 2006 (Cth), this reform involves the equal custody of the child. However, this isnââ¬â¢t always the case as the child may end up back with their abusive parent as seen in the Whitehead v Storn. The court system has shown to have responded to many issues of different areas of family law however, some of the attempts of reforms have demonstrated to be ineffective.
